Terms of service

These terms cover your use of modushold.com and any order you place with us. By using the site or placing an order, you accept them. We sell into New Zealand and Australia, and nothing in these terms reduces your rights under the New Zealand Consumer Guarantees Act, the Fair Trading Act, or the Australian Consumer Law. Those rights apply on top of everything here and cannot be excluded.
Ordering
Placing an order is an offer to buy. We accept it when we send your confirmation email. If we cannot fulfil an order, for example because an item is out of stock or a price was listed in error, we will tell you and refund you in full.
Prices and payment
Prices are shown in New Zealand dollars unless your currency selector says otherwise, and include GST where it applies. Prices can change, but a change never affects an order we have already accepted. Payment is taken at checkout through our payment provider.
Shipping and delivery
Delivery times are estimates given in good faith, not guarantees, because carriers are outside our control. Risk passes to you on delivery. Full details are on our shipping page.
Returns, refunds and warranty
Our 30-day change of mind policy and our 12-month warranty are set out on the shipping and warranty pages, and form part of these terms. Your statutory rights sit on top of them.
Using the site
Do not misuse the site, attempt to break into it, scrape it, or use it for anything unlawful. We may suspend access if you do.
Our content
The Modus Hold name, logo, product designs, photography and copy on this site belong to us. You may not copy or reuse them commercially without our written permission.
Accuracy
We work hard to describe products accurately, including dimensions and insulation performance. Some figures are supplied by our manufacturer and are measured by hand, so small variations are possible. If a product arrives materially different from its description, your consumer law rights apply.
Liability
Nothing here limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited, including the guarantees given by New Zealand and Australian consumer law. Subject to that, our liability for any order is limited to the amount you paid for it.
Governing law
These terms are governed by New Zealand law, and the New Zealand courts have jurisdiction. Australian customers keep the protections of Australian consumer law.
